From the municipal group of Izquierda Unida-Verdes we want to ask the municipal plenary to include social clauses in public contracts.
These clauses are specific criteria applicable to public procurement processes whose purpose is to promote beneficial behaviors for the general good.
With the inclusion of these clauses, not only the best service would be sought by the winning company, taking into account the different established criteria, but also that certain types of social policies would be developed: environmental, equality plans , specific gender clauses, or even a new relationship with companies in the third sector, promoting, for example, practices such as fair trade.
The main objective of these clauses would be that the companies hired by the municipality are socially responsible, which is compatible with the ultimate goal of effective and efficient provision of public resources by selecting the most advantageous offer with social benefits achievements.
From the Municipal Group of United Left-Greens we have always bet that the different municipal services are under the public management, but in certain occasions the city councils are unable to assume the direct service, especially by the limitation of incorporation of labor personnel to the sector public and the subrogation of the workers of the private company to direct management.
In addition, the inclusion of social clauses is something already requested by the European Union with the approval of several directives that stipulate it.
Moreover, it asks that more points be given to companies that opt ​​for public contracts and comply with this type of social and environmental requirements.
City councils such as Zaragoza or Madrid have already begun to include these clauses with ample guarantee of success.
It should also be remembered that this is not the first time that the establishment of this type of clauses has been discussed in the contracts of our city council.
In January 2015, this matter was submitted to debate in the Municipal Plenary, although the proposal was rejected alone by the governing team of the Popular Party, alluding to the introduction of social criteria within the contracts offered in public tender by our municipality. , as they could be, for example, the subrogation of the contracts of the staff maintaining the number of workers, or encourage the hiring of unemployed workers by the winning companies.
Even so, we believe that the creation of an instruction should be considered in which the possibility of applying these clauses is contemplated, in which a greater number of Clauses of this type can be proposed.
In conclusion, what we intend from the Municipal Group of United Left - Greens is that the necessary steps are taken for the creation of a decree that allows us to establish these criteria and that the neighbors of our locality, besides receiving the best of the services with these contracts, are also benefited by the use of social policies within these contracts.
