The Justice has recently ruled that the City Council of Yecla has been imposing fines illegally for the possession of narcotics on public roads since 2016 and, therefore, the rights of dozens of Yecla citizens were being violated.

This circumstance, which we already denounced in September, has been accredited in judgment 43/2020 of the Contentious Administrative Court No. 5 of Murcia that declares a sanction processed by the City of Yecla for possession of narcotic substance as null.

Thus, the judicial resolution concludes on its second right basis that “the specific legislation does not confer jurisdiction of the CITY COUNCIL of YECLA to sanction for the violation of art.

36.16 �of Organic Law 4/2016 and therefore declares the resolution as contrary to law.

By extension, all the sanctioning procedures opened by the City Council of Yecla for violation of article 36.16 of the aforementioned organic law are null and void based on said judgment.

Therefore, from the Municipal Group of IU-Greens in the City of Yecla, we believe that dozens of people are causing very serious economic and social damage.

In addition, these illegal and disproportionate fines, which sometimes reach the amount of € 10,401, worsen addiction situations, instead of helping to eliminate them.

So, we have requested the Mayor by means of a written request for the following actions:

-The immediate archiving of all the sanctioning procedures opened by the City Council of Yecla regarding the possession of narcotic substances due to lack of powers for processing.

-The non-initiation of more disciplinary proceedings for violation of article 36.16 of LO 4/2016.

-And that it be informed in writing of the economic impact to the municipal coffers that will have the nullity of all the fines imposed illegally.
